you use our website, tvx.international, and our intermediary GDS dispatch system.
2. ROLE OF DATA CONTROLLER & PROCESSOR
TVX AIRLINE SYSTEM CORP acts as a data intermediary and controller of the personal
data provided during your initial service request. Because our core function is to
forward transportation bookings, we share this data with our network of independent
Global Distribution System members ("GDS Members"), who fulfill the transportation
and conduct payment operations.
3. INFORMATION WE COLLECT
We collect personal information necessary to facilitate ground transportation requests,
including but not limited to:
- Contact Information: Full name, phone number, email address.
- Booking & Itinerary Details: Pickup location, drop-off location, date/time,
flight numbers, special luggage or passenger requests.
- Technical & Usage Data: IP address, browser type, device information, and site
usage metadata collected automatically via cookies.
*Note: TVX AIRLINE SYSTEM CORP DOES NOT collect or store full credit card numbers or
financial billing credentials on our servers. Financial data is collected directly
by the fulfilling GDS Member or their authorized payment processor.*
4. MANDATORY DATA SHARING WITH GDS MEMBERS
(a) Purpose-Driven Sharing: You hereby explicitly acknowledge, authorize, and consent
to TVX AIRLINE SYSTEM CORP sharing, transferring, and disclosing your personal information
(including name, phone number, and itinerary) to independent third-party GDS Members.
(b) Sole Purpose: Such data sharing is performed strictly and exclusively for the
purposes of:
(i) Evaluating, dispatching, and accepting your transportation requests;
(ii) Allowing GDS Members to contact you regarding pickup coordinates, driver
updates, and itinerary execution;
(iii) Enabling GDS Members to invoice, bill, and process payment for services
rendered directly to you.
(c) Independent Controllers: Once your information is transferred to a GDS Member
to complete a booking, that GDS Member becomes an independent data controller with
respect to the processing and billing of that transaction.
5. THIRD-PARTY DISCLOSURES AND DATA TRANSFERS
In addition to GDS Members, we may disclose your information to:
- IT and cloud hosting providers that maintain our platform infrastructure;
- Law enforcement, regulatory bodies, or legal authorities when required by mandatory law.
We do not sell, rent, or trade your personal information to third parties for external
marketing or advertising purposes.
6. DATA SECURITY
We employ industry-standard technical and organizational security measures to protect
your data against unauthorized access, loss, or alteration while in transit across
our Platform. However, no internet-based system is 100% secure, and we cannot
guarantee absolute security.
7. DATA RETENTION
We retain your request data only as long as necessary to fulfill the operational
coordination between you and GDS Members, or to comply with legal, statutory, and
audit obligations.
8. YOUR PRIVACY RIGHTS
Depending on your jurisdiction (e.g., GDPR, CCPA/CPRA), you may have the right to
access, correct, delete, or restrict the processing of your personal data held by us.

*Requests regarding billing records or driver communications managed directly by a
GDS Member must be submitted directly to that specific GDS Member.*

1. SCOPE AND AGENT/MIDDLEMAN CAPACITY
TVX AIRLINE SYSTEM CORP ("Company," "TVX International," "we," "us," or "our")
operates strictly as a Global Distribution System (GDS), intermediary dispatch
platform, and booking technology facilitator via tvx.international (the "Platform").
The Company IS NOT a direct ground transportation provider, motor carrier, taxi
service, or billing entity for end-user services.
By accessing or submitting a service request through this Platform, you (the "User",
"Client", or "Customer") acknowledge and agree that TVX AIRLINE SYSTEM CORP's sole
function is to receive, process, and forward your transportation requests to
independent, third-party ground transportation operators and affiliate members
participating in our GDS network ("GDS Members").
2. BILLING, PAYMENT, AND DIRECT OPERATOR FULFILLMENT
(a) No Direct Billing by Company: TVX AIRLINE SYSTEM CORP DOES NOT perform direct
billing, credit card processing, invoicing, or payment collection for the underlying
transportation services requested.
(b) GDS Member Responsibility: All billing, merchant card transactions, invoicing,
cancellation fees, wait-time adjustments, tolls, gratus, and final charges are
executed directly by the respective GDS Member assigned to fulfill your request.
(c) Binding Merchant Contracts: When a request is accepted, a direct contract is
formed exclusively between the Customer and the assigned GDS Member. TVX AIRLINE
SYSTEM CORP is not a party to this financial or service contract. Any billing
disputes, chargebacks, refund requests, or invoicing queries MUST be directed
solely to the fulfilling GDS Member.
3. LIMITATION OF LIABILITY & DISCLAIMER OF WARRANTIES
(a) "As-Is" Platform Provision: The Platform is provided on an "AS IS" and "AS
AVAILABLE" basis. TVX AIRLINE SYSTEM CORP makes no warranties, express or implied,
regarding the availability, timeliness, safety, or quality of the transportation
services provided by GDS Members.
(b) Intermediary Immunity: Under no circumstances shall TVX AIRLINE SYSTEM CORP,
its officers, directors, employees, or agents be liable for any direct, indirect,
incidental, special, consequential, or punitive damages arising out of or related
to:
(i) Errors, delays, missed pickups, accidents, personal injuries, property
damage, or service failures caused by GDS Members;
(ii) Billing disputes, overcharges, unauthorized fees, or card processing
errors committed by GDS Members;
(iii) Unavailability of the GDS transmission platform or network failures.
(c) Liability Cap: To the maximum extent permitted by applicable law, TVX AIRLINE
SYSTEM CORP's total aggregate liability for any claims related to the Platform
shall not exceed $100.00 USD.
4. USER REPRESENTATIONS AND REQUEST TRANSMISSION
By submitting a request, you certify that:
(i) All information provided (pickup locations, flight details, contact info) is accurate;
(ii) You understand that submitting a request does not guarantee fulfillment until a
GDS Member formally accepts and confirms the job;
(iii) You authorize TVX AIRLINE SYSTEM CORP to transmit your booking details to any network
GDS Member necessary to complete your dispatch.
5. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless TVX AIRLINE SYSTEM CORP and its
affiliates from and against any claims, damages, liabilities, costs, or expenses
(including legal fees) arising from your breach of these Terms, your interaction with
any GDS Member, or your violation of any third-party rights or applicable laws.
6. GOVERNING LAW AND JURISDICTION
These Terms & Conditions shall be governed by and construed in accordance with
applicable regional and international commercial laws, without regard to conflict
of law principles. Any dispute arising out of or relating to the Platform shall
be resolved exclusively in the courts having jurisdiction over TVX AIRLINE SYSTEM CORP's
registered head offices in Ontario, Canada.
